El presente documento regula la relación comercial entre los usuarios del sitio web dybarberz.com y la marca global DYBARBERZ, operada de manera conjunta y coordinada por la empresa DE BE IMPORT EIRL RUC: 20614263912 (constituida Lima-Perú, encargada de la custodia de la marca, logística de exportación, empaquetado y control de calidad) y DEBE IMPORTA LLC 38-4363569(constituida en el estado de Nuevo Mexico, Estados Unidos de América, encargada de la recaudación internacional de pasarela de pagos mediante Stripe y de la gestión administrativa global de cobros). Al realizar una compra en nuestro sitio web, usted acepta los siguientes términos y condiciones sin reservas.

1.Declaración de Exclusividad y Drops de Inventario Limitado

DYBARBERZ produce herramientas de barbería bajo diseño exclusivo de edición limitada (denominados comerciales "Drops"). En consecuencia:

No se garantiza la reposición constante de existencias.

El producto agregado al carrito de compras no queda reservado hasta que se complete exitosamente la transacción de pago internacional.

2.Pasarela de Pagos de Recaudación (Stripe y LLC)

Todas las compras realizadas a través del portal son procesadas internacionalmente por DEBE IMPORTA LLC Nº3--4363569 en USD (Dólares de los Estados Unidos de América) o la moneda equivalente según se configure en la pasarela Stripe. El cliente autoriza de manera expresa este flujo de procesamiento.

NO INCLUYEN impuestos locales de importación o aduanas.
DyBarberz no se hace responsable por retenciones debidas a la falta de pago de impuestos por parte del cliente.

3. Condiciones de Logística de Envío y Transferencia de Riesgo (DHL)

El despacho de los productos se realiza de manera centralizada desde nuestros almacenes operativos en Lima, Perú a través de la empresa de transporte global DHL Express

Transferencia de Riesgo: De conformidad con las leyes comerciales internacionales (Incoterms 2020 equivalentes a FOB/FCA Lima), la responsabilidad del resguardo físico de la mercadería se transfiere al transportador y al cliente en el momento exacto en que el paquete es recibido por DHL. DYBARBERZ no se hace responsable por daños causados por "mal viaje", manipulación defectuosa de aduanas, aperturas de inspección aduanera de tránsito o demoras extremas del servicio de transporte.

Obligación de Unboxing de Verificación: Para que cualquier reclamación de daño por transporte o defecto sea procesada, el cliente DEBE obligatoriamente registrar un video continuo sin cortes de la apertura de la caja ("Unboxing") que sirva como prueba indubitable del estado físico del embalaje y del producto al momento de su arribo.

4. Impuestos, Aranceles y Despacho de Importación

El precio de venta reflejado en el sitio web no incluye tasas de importación, impuestos generales a las ventas (IGV/VAT), ni aranceles locales del país de destino.

El cliente final es calificado formalmente como IMPORTADOR DE REGISTRO en su respectiva jurisdicción nacional.

Es obligación absoluta del cliente saldar cualquier impuesto de aduanas. El rechazo a liquidar dichos aranceles facultará a la transportadora a destruir o retornar la mercancía, sin derecho a reembolso del precio pagado a favor del cliente.

5. Política de Cambios Limitada y Costos de Envío de Retorno

Debido al inventario altamente exclusivo y de edición limitada de las tijeras:

No se aceptan retractos o cambios por error de selección de talla, peso o configuración para diestros/zurdos por parte del cliente una vez efectuado el envío.

Si excepcionalmente se califica y autoriza un cambio por la empresa, el cliente deberá pagar íntegramente los costos asociados al envío de retorno hacia Perú, así como los gastos del reenvío del nuevo producto.

6. Limitación de Garantía Técnica (6 Meses)

DYBARBERZ ofrece una garantía técnica limitada contra fallos estructurales de fabricación o de calidad del acero por un periodo máximo de seis (6) meses naturales a partir de la fecha confirmada de entrega del pedido por DHL.

Quedan totalmente excluidos de esta garantía los desgastes normales del filo provocados por el uso continuo, golpes provocados por caídas accidentales de la tijera, descalibración del tornillo por mal mantenimiento, o daños producidos por la limpieza con agentes químicos corrosivos no recomendados.

7. Legislación Aplicable y Jurisdicción

Cualquier controversia relacionada con las transacciones comerciales internacionales o reclamaciones de propiedad intelectual se someterá en primera instancia a los tribunales del Estado de Nuevo Mexico, Estados Unidos para temas vinculados al cobro, y a los tribunales del Distrito Judicial de Lima - Miraflores, Perú para temas vinculados a la manufactura, empaquetamiento y exportación de la mercadería física.

This document governs the commercial relationship between users of the website dybarberz.com and the global brand DYBARBERZ, jointly operated and coordinated by DE BE IMPORT EIRL RUC: 20614263912 (incorporated in Lima, Peru, responsible for brand ownership, export logistics, packaging, and quality control) and DEBE IMPORTA LLC 3-84363569 (incorporated in the state of New Mexico, United States of America, responsible for international payment collection via Stripe and global administrative management of collections). By making a purchase on our website, you accept the following terms and conditions without reservation.

1. Declaration of Exclusivity and Limited Inventory Drops

DYBARBERZ produces barber tools with exclusive, limited-edition designs (referred to as "Drops"). Therefore:

Constant stock replenishment is not guaranteed.

The product added to the shopping cart is not reserved until the international payment transaction is successfully completed.

2. Collection Payment Gateway (Stripe and LLC)

All purchases made through the portal are processed internationally by DEBE IMPORTA LLC Nº3--4363569 in USD (United States Dollars) or the equivalent currency as configured in the Stripe payment gateway. The customer expressly authorizes this processing.

The customer is solely responsible for paying any tariffs, taxes, or customs fees required by their country's legislation upon receiving the package.
DyBarberz is not responsible for withholdings due to the customer's failure to pay taxes.

3. Shipping Logistics and Risk Transfer Conditions (DHL)

Product shipments are centrally managed from our operational warehouses in Lima, Peru, via the global shipping company DHL Express.

Transfer of Risk: In accordance with international trade laws (Incoterms 2020 equivalent to FOB/FCA Lima), the responsibility for the physical safekeeping of the merchandise is transferred to the carrier and the customer at the exact moment the package is received by DHL. DYBARBERZ is not liable for damages caused by mishandling, improper customs handling, transit customs inspections, or extreme delays in the shipping service.

Unboxing Verification Obligation: In order for any claim of transport damage or defect to be processed, the customer MUST record a continuous, uncut video of the opening of the box ("Unboxing") that serves as irrefutable proof of the physical condition of the packaging and the product upon arrival.

4. Taxes, Duties, and Import Clearance

The sale price shown on the website does not include import duties, general sales taxes (VAT), or local tariffs of the destination country.

The end customer is formally registered as a REGISTERED IMPORTER in their respective national jurisdiction.

It is the customer's absolute responsibility to pay any customs duties. Refusal to pay these duties will entitle the carrier to destroy or return the merchandise, without the customer being entitled to a refund of the price paid.

5. Limited Exchange Policy and Return Shipping Costs

Due to the highly exclusive and limited-edition nature of these scissors:

No returns or exchanges are accepted for incorrect size, weight, or right-handed/left-handed configuration selection by the customer once the order has been shipped.

If, exceptionally, the company approves and authorizes an exchange, the customer will be responsible for all return shipping costs to Peru, as well as the shipping costs for the new product.

6. Technical Warranty Limitation (6 Months)

DYBARBERZ offers a limited technical warranty against structural manufacturing defects or steel quality issues for a maximum period of six (6) calendar months from the confirmed delivery date of the order by DHL. This warranty excludes normal wear and tear of the blade from continuous use, impacts from accidental drops of the scissors, screw misalignment due to improper maintenance, or damage caused by cleaning with corrosive chemical agents that are not recommended.

7. Applicable Law and Jurisdiction

Any dispute related to international commercial transactions or intellectual property claims will be submitted in the first instance to the courts of the State of Nuevo Mexico, United States, for matters related to collection, and to the courts of the Judicial District of Lima - Miraflores, Peru, for matters related to the manufacture, packaging, and export of the physical merchandise.
